Rahul Gandhi Reinstated as MP After Supreme Court Stays Defamation Conviction – How and Why?

Rahul Gandhi, the former president of the Indian National Congress, was reinstated as a Member of Parliament (MP) on August 7, 2023, after the Supreme Court stayed his conviction in a criminal defamation case.

Gandhi was convicted by a Surat court in Gujarat in March 2023 for making defamatory remarks about the then Chief Minister of Gujarat, Narendra Modi, in 2019. The court sentenced him to two years in prison, which would have disqualified him from being an MP.

Gandhi appealed the conviction to the Gujarat High Court, but the court dismissed his petition in May 2023. He then filed a special leave petition in the Supreme Court, which granted him a stay on the conviction on August 5, 2023.

The Supreme Court’s stay order effectively reinstated Rahul Gandhi as an MP. The Lok Sabha secretariat issued a notification to this effect on August 7, 2023.
